http://www.click2houston.com/news/2604851/detail.html Officials: Boy Acted Suspicious In Movie Theater Parking Lot p.m. CST November 3, 2003 HOUSTON -- The parents of a teen allegedly killed by an off-duty police officer want to know what caused the officer to shoot. The parents filed a civil lawsuit Monday against the Houston police officer who reportedly shot their 15-year-old son, Jose Vargas Jr., as he cruised a southwest Houston's movie theater parking lot Friday night with three of his friends Houston police said the teen was driving slowly and looked suspicious in an area that has been recently hit with a rash of stolen cars and vehicle break-ins. The off-duty Houston police officer, who was working as a security guard at the theater, caught up with Vargas, pointed his gun at him and fired, hitting the teen in his chest. The Houston Police Department said the officer's gun accidentally fired when the teen stepped on the accelerator, hitting the officer's arm. Vargas was transported to a nearby hospital where he died. The attorney for the Vargas family said the shooting was not an accident, but an over-reaction to cruising.
